Legal and Regulatory Analysis of Riverbed and Riparian Zone Boundaries with Legislative Reform and Policy Recommendations

The Parliament’s Research Center published this report in response to the growing legal disputes, encroachments, and damages related to riverbeds and buffer zones. Recent floods, illegal constructions, and poor coordination among responsible institutions have shown that the current laws from the 1980s and 1990s are no longer effective.

This analysis identifies six key challenges:

1️⃣ Variability of riverbed boundaries over time

2️⃣ Impacts of climate change on river limits

3️⃣ Lack of long-term hydrological data

4️⃣ Difficulty distinguishing natural from human-induced factors

5️⃣ Undefined riverbed boundaries in many rivers

6️⃣ Uncertainty in calculating quantitative and qualitative buffer zones

🔹 The report emphasizes that determining riverbeds and buffer zones must be a dynamic, scientific, and regularly updated process.

🔹 Proposed reforms include revising Article 2 of the Fair Water Distribution Act, clarifying ownership rights, mandating periodic updates of boundaries, and amending the 2000 bylaw to prevent conflicts of interest, encroachments on public lands, and environmental degradation.
